Terms of Service

1. Acceptance of Terms

Welcome to Ratemy ("we," "our," or "us"). By accessing or using the Ratemy platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users, including:

  • Reviewers: Individuals who write reviews about professionals
  • Professionals: Managers, teachers, doctors, lawyers, and other professionals who are reviewed
  • Parents: Parents reviewing teachers or schools
  • Recruiters: Individuals or companies searching for talent
  • Job Seekers: Individuals browsing job postings

2. Account Registration

2.1 Minimum Age Requirements

You must be at least 13 years old to use the Service. By creating an account, you represent and warrant that you are at least 13 years of age. This minimum age requirement is in compliance with the Children's Online Privacy Protection Act (COPPA).

During registration, you will be required to provide your date of birth to verify your age. If we learn or have reason to believe that a user is under 13 years of age, we will immediately terminate the account and delete all associated personal information as required by law.

Important for Parents/Guardians

If you are a parent or guardian and you learn that your child under 13 has created an account without permission, please contact us immediately at privacy@www.ratingapp.net and we will delete the account.

2.2 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and any activities or actions under your account.

2.3 Account Types

  • Free Accounts: Basic access to platform features
  • Premium Accounts: Enhanced features including unlimited AI Coach sessions, advanced analytics, and priority support
  • Enterprise Accounts: Team features, SSO, and dedicated support

3. Review Guidelines

3.1 Review Standards

All reviews must:

  • Be based on genuine personal experiences with the professional
  • Be truthful, accurate, and non-misleading
  • Not contain personally identifiable information (PII) such as addresses, phone numbers, or email addresses
  • Not contain profanity, hate speech, threats, or harassment
  • Not be written in exchange for compensation or incentives
  • Comply with all applicable laws and regulations

3.2 Professional Consent

Reviews of professionals are subject to approval by the professional before publication. Professionals have the right to:

  • Approve or reject reviews
  • Request modifications to reviews containing inaccuracies
  • Respond publicly to reviews
  • Dispute reviews that violate our guidelines

3.3 Anonymous Reviews

You may choose to submit reviews anonymously. However, anonymous reviews may receive lower trust scores and visibility. You can un-anonymize your review at any time to increase trust.

3.4 AI Moderation

All reviews are automatically screened using AI moderation for:

  • Personally identifiable information (PII)
  • Toxic or offensive language
  • Spam or fraudulent content
  • Violations of community guidelines

Reviews flagged by AI moderation may be reviewed by our team before publication.

4. Professional Profiles

4.1 Unclaimed Profiles

Professionals may be added to the platform by reviewers without prior consent. Unclaimed profiles may display publicly available information and reviews.

4.2 Profile Claiming

Professionals can claim their profiles by:

  • Creating an account with the email associated with the profile
  • Verifying their identity through LinkedIn OAuth or other verification methods
  • Completing the profile claim workflow

4.3 Profile Verification

Professionals can apply for verified status by providing:

  • LinkedIn account verification
  • Employment verification documents
  • Professional licenses or certifications (where applicable)

Verified profiles receive increased visibility and a verification badge.

5. Dispute Resolution

5.1 Review Disputes

Professionals may dispute reviews that:

  • Contain false or misleading information
  • Are written by someone who did not work with the professional
  • Contain harassment, defamation, or hate speech
  • Violate these Terms of Service

5.2 Dispute Process

  1. Professional submits dispute with evidence
  2. Our team reviews the dispute within 2-3 business days
  3. Reviewer may be contacted for additional verification
  4. Decision is final unless new evidence is provided

5.3 Appeal Process

If a dispute is rejected, you may appeal within 14 days by providing additional evidence. Appeals are reviewed by senior moderators.

6. Intellectual Property

6.1 User Content

By submitting content (reviews, comments, photos, videos) to the Service, you grant Ratemy a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the Service.

You retain all ownership rights in your content. You can delete your content at any time, but copies may remain in backups for a reasonable period.

6.2 Platform Content

The Service and its original content, features, and functionality are owned by Ratemy and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Prohibited Activities

You may not:

  • Use the Service for any illegal purpose or in violation of any laws
  • Impersonate another person or entity
  • Submit false, defamatory, or misleading reviews
  • Attempt to manipulate ratings or reviews
  • Scrape, crawl, or data mine the Service without permission
  • Interfere with or disrupt the Service or servers
  • Transmit viruses, malware, or other malicious code
  • Harass, abuse, or harm other users
  • Sell or transfer your account to another party
  • Use automated tools (bots) to access the Service

8. Premium Features & Billing

8.1 Subscription Plans

Premium features require a paid subscription. Available plans include:

  • Parent Premium ($4.99/mo or $49.99/yr): Track 20 teachers, rating alerts, PDF reports
  • Professional Premium ($19.99/mo or $199.99/yr): Unlimited AI Coach, advanced analytics
  • Recruiter Premium ($49.99/mo or $499.99/yr): Advanced filters, unlimited searches
  • Enterprise (Custom): Team features, SSO, dedicated support

8.2 Payment Terms

Subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method on a recurring basis. If payment fails, we will attempt to collect payment for up to 14 days before canceling your subscription.

8.3 Cancellation & Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial months or unused time, except as required by law.

8.4 Job Posting Fees

Job postings are one-time purchases with the following tiers:

  • Basic ($99): 30 days, standard listing
  • Standard ($299): 60 days, featured placement, manager highlights
  • Premium ($499): 90 days, top placement, manager video

Job posting fees are non-refundable once the job is published.

9. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • The quality of any products, services, information, or other material obtained through the Service will meet your expectations
  • All reviews are truthful, accurate, or complete
  • User-generated content is free from viruses or other harmful components

Reviews represent the opinions of individual users and do not reflect the views of Ratemy.

10. Limitation of Liability

In no event shall Ratemy, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service
  • User content or the defamatory, offensive, or illegal conduct of any third party

Our total liability for any claims under these Terms, including for any implied warranties, is limited to the amount you paid us to use the Service in the 12 months prior to the claim (or $100, whichever is greater).

11. Indemnification

You agree to indemnify, defend, and hold harmless Ratemy and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

  • Your use of and access to the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including copyright, property, or privacy rights
  • Any claim that your content caused damage to a third party
  • Your reviews or other user-generated content

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • At our sole discretion

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may do so through your account settings.

13. Governing Law & Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

13.2 Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California.

You waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.

13.3 Exceptions to Arbitration

Either party may bring a lawsuit in court for injunctive relief or to protect intellectual property rights.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a prominent notice on the Service at least 30 days before the changes take effect.

Your continued use of the Service after changes to the Terms constitutes your acceptance of the new Terms.
